Kirusa Privacy Policy

This Privacy Policy is formulated to publicize to the users our policies and procedures regarding the collection, use and disclosure of personally identifiable information collected in connection with the Call-n-Tweet Service being provided by Kirusa, by way of which users can record any voice message and share it over the Internet (hereinafter referred to as “the Service”).

Although we may attempt to notify you when major changes are made to this Privacy Policy, you are responsible for periodically reviewing any changes which may be made to the Policy. We may, in its sole discretion, modify or revise the Policy at any time, and you agree to be bound by such modifications or revisions.

If you have any questions or comments about this Privacy Policy or our use of your personally identifiable information, please contact us at callntweet@kirusa.com.

  1. Personal Information

    1. You can listen to Voice Tweets on callntweet.com without having a Call-n-Tweet Account. However, in order to access some features related to the Service, such as allowing people to recognize your Voice Tweets or comments, you may be required to create a Call-n-Tweet account for which some personal information may be required.

    2. We may record information about your usage, such as when you use the Service, the contacts you communicate with, the Voice Tweets you listen to, and the frequency and size of data transfers, as well as information you display or access using the Service. If you are logged in, we may associate that information with your account.

    3. Any personal information or audio content that you voluntarily disclose on our site becomes publicly available and can be collected and used by others.

  2. Uses

    1. If you submit personal information to us, we may use that information to operate, maintain, and improve the functioning of the Service.

    2. We do not use your email address or other personal information to send commercial or marketing messages without your consent. We may use your email address without further consent for non-marketing or administrative purposes (such as notifying you of major changes to the Service or for customer care).

    3. We use cookies, web beacons, and log file information to: (a) store information so that you will not have to re-enter it during your visit or the next time you access your Account; (b) provide custom, personalized content and information; (c) monitor the effectiveness of our marketing campaigns; (d) monitor aggregate metrics such as total number of visitors and pages viewed; and (e) track your entries, submissions, and status in promotions, sweepstakes, and contests.

    4. We engage certain trusted third parties to perform functions and provide services to us, including, without limitation, hosting and maintenance, customer relationship, database storage and management, and direct marketing campaigns. We will share your personally identifiable information with these third parties, but only to the extent necessary to perform these functions and provide such services, and only pursuant to binding contractual obligations requiring such third parties to maintain the privacy and security of your data.

  3. Information that is publicly available

    1. When you create a Call-n-Tweet Account, some information about your Account and your account activity will be provided to other users of the Service. This may include the date you opened your Account, the date you last logged into your Account, your age (if you choose to make it public), the country and the number of Voice Tweets you have accessed.

  4. Sharing Information

    1. As a matter of policy, we will not sell or rent information about you and we will not disclose information about you in a manner inconsistent with this Privacy Policy except as required by law or government regulation. We cooperate with law enforcement inquiries, as well as other third parties, to enforce laws such as those regarding intellectual property rights, fraud and other personal rights.

    2. WE CAN (AND YOU AUTHORIZE US TO) DISCLOSE ANY INFORMATION ABOUT YOU TO LAW ENFORCEMENT, OTHER GOVERNMENT OFFICIALS, OR ANY OTHER THIRD PARTY THAT WE, IN OUR SOLE DISCRETION, BELIEVE NECESSARY OR APPROPRIATE IN CONNECTION WITH AN INVESTIGATION OF FRAUD, INTELLECTUAL PROPERTY INFRINGEMENT, OR OTHER ACTIVITY THAT IS ILLEGAL OR MAY EXPOSE US, OR YOU, TO LIABILITY.

  5. Business Transfers

    1. Kirusa may sell, transfer or otherwise share some or all of its assets, including your personally identifiable information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy. You will have the opportunity to opt out of any such transfer if the new entity's planned processing of your information differs materially from that set forth in this Privacy Policy.

  6. Security

    1. Kirusa is very concerned about safeguarding the confidentiality of your personally identifiable information. We employ administrative, physical and electronic measures designed to protect your information from unauthorized access.

    2. We will make any legally-required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored personal data to you via email or conspicuous posting on this Site in the most expedient time possible and without unreasonable delay, consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.
